Someone said that records can't be hidden and if they are, they can't be used against you.

Although they can use that to brick flashcarts and that it.

but if it is hidden, even after formatting, they can simply refuse help and [online] service
and the system update says: MAY brick, who care about will or going to or whatever

the possibility is there, they might force an "accidental" update that they intend to use to brick your console, but the update doesn't seem like it was made for that purpose
so what then?
they warned you, they don't look like they intentionally wanted to brick your console in the eyes of the law
in the end, you might still hold a bricked console in your hands

there are many-many-many way around the law, nothing is 100%

I have a question, I can access the dairy where I can see what I played today, I can delete played shit too, is IT save to USE my flashcard?

Not only Nintendo wouldn't try that because they are Nintendo and the fact if they get caught they are screw.

Not only that they lose the reputation and credibility, they can be mark as criminals by customers eyes.

Getting around the law doesn't mean the law isn't broken.

Accidental force update, how can they have a accidental force update?

it's not accidental update, it's that they release an update the bricks your console while the updates seems like nintendo didn't want to

but yeah, my hopes are in nintendo too, i mean, these things sounds like it'd come from sony

but at this point, i still refrain from using flashcarts on my 3ds
still have the dsi, so it'll work fine, what i really want to see is what will happen after the may update

you can demand full refund its pretty easy
with what "reason did they brick your console?"
hidden things that you arent aware of are illegal to be used against you
always the same question always the same answers

btw i bought 2 games already (atm no flashcard emulates 3d)
and i already have seen every game case in the back
every game still says "MAY render your console unplayable"
same old same old
i already gave my dsi for a 100 euros discount on 3ds ^^ (i have used 3 different flashcard on the dsi i had oh and what do you see it still works)
they wouldnt have bought back my dsi if nintendo would render it unusable

Its easy as I have said a number of times before. A smart flash cart company would let you point at a legit rom image, and pull the header details and icon into the system file updater for their cart (kinda like build your own header). Then when you flash the cart with this new sytem file update you can have whichever rom icon and details you wanted. Its more believable for a player in the UK to have 500hours playing pokemon EU than some small unknown JAP rom in their log.

This way they would not know which cart to block, as you would all be using different rom headers and therefore have different activity logs.

Having the same details in all logs gives Nintendo data to analyse, basically the flash cart companies are advertising the details to Nintendo in the logs.

Is that possible on any Flashcart at this time? Like Acekard if you play a game through it will the 3DS read the game or still as the flashcart?

From what I have seen, if you play a game using a flashcart it displays the icon and rom details in the activity logs that is used by the flashcart not the game you play on it. Thats why I think its key that this can be changed.

Nintendo CAN'T do anything.

-They CAN'T brick your console.
-They CAN'T use the information that they get against you.
-They CAN'T do anything against us.

All what they will do if they see someone playing on a flashcard, will be an UPDATE. Nothing more than an UPDATE. They CAN'T do anything to you.

So, play on your flashcard. They will not do anything to you. They CAN'T.

that is until they decide to block you away from their online service or block your flashcart or if we have cfw[would be a miracle] and the update would brick it
if they would be able do do anything against you, then all the existing ds cards would work on all ds's and on all their fimrware versions

if u only mean bricking[which your post is totally not about], then read above
