So I updated to play luigis mansion because its an incredible well made game. Now I'm thinking of buying a new 3Ds while you can still get them on the old firmware. Waste of money?

No, and most 3DS' aren't on the latest firmware when you buy them, they require an update.
So you could always sit and wait, but it really is a waste of time, donate to the decapping fund if you really want to see some progress.

I really dont know how they are working with 3DS, but when I got my DSi it was on 1.2 ver, and 1.4 was already released at that time, so I think that if you wait 'til homebrew comes, you still be able to get an old version 3DS.
