Hacking 3DS freeze even when R4 Gold is not inserted

hi forum,

i got the typical black screen "an error occured" (in german it's "es ist ein fehler aufgetreten", don't know the exact english translation), even when the r4 gold card is not inserted. typically it occurs when i try to access system settings, sometimes also if i try to start a game (e.g. mario kart 7). is is behaviour normal, is the 3ds able to track down that i used a r4 gold card?
or is it just a genereal problem with the console (i bought it on ebay).

That's not normal, I suggest you return it for a replacement.

I'd link you to the nintendo warranty page, but I don't know the german version.
