Homebrew 3DS anti-piracy update?

There is a lot of conflicting reports in the articles I read about what the newest system update does, so I want to know what is safe and what isn't?

I have ripped copies of game that I own which I installed on my console so I didn't need the card but they would probably be flagged as pirate copies. I've been wait to update till I could see that it's safe but just looking around I can't get the answers I'm looking for so best to just ask the community directly.

Will you only get banned if you access online services in a pirated game or is just lunching the game while connected to the internet enough to get banned?

Edit: Also should I worry in Ultra Sun/Moon when it makes you go to the "carnival grounds"(the online interaction place) place

The latest update does not bring any higher ban risk. Using installed games is as fine as it was before the 11.8 update. The only change is:

You have to provide a valid ticket to be able to download anything from the Nintendo servers. Software like Freeshop does not work anymore.
