You're a little late. It's been like that since 1.03 IIRC.

EDIT: I don't know why, but the simple hotkey still doesn't work for me in ToI outside of the items menu.

Have you got both 'hotkey' and 'hotkey1' set to the same key-combo ??

It seems that if you do it'll ignore 'hotkey1'

- I did mention something about this where if you have both set the same it'll go straight into the 'normal' hotkey with RTS etc (but that was with a normal ROM) & if 'ToI' is one of those 'special' ROMS then I guess it'll ignore the hotkey1 altogether

If you do have both hotkey(s) set to the same key combo - try changing one of them
(I have [ left ][ right ]+[start] as one & [ left ][ right ]+[select] as the other) & see if that makes a difference
 
I don't have an "hotkey1" option. My 1.06 says "Full hotkey" and "Simple hotkey".
BTW, I had the full one set to L+R+X and the simple one set to L+R+Y, but it still doesn't work.

Hmm that's weird - It seems there's been a update to the update or something

I got the 1.06 when it first came out & I had 'Hot key' and 'Hotkey1' - but I've just downloaded the 1.06 just now & tried it out & that now says 'Full hotkey' and 'Simple hotkey' like 'YayMii'

EDIT: Ah hang on - I think I've found the problem

When I updated originally - I copied over the files into the existing DSTwo folder EXCEPT the 'Globalsetting.ini' (since I wanted to keep those set up), plus (or so I thought) the 'ui' & 'plug' folders (I have custom graphics which I didn't want to lose)

It seems I forgot to copy over the 'Language' folder as well - 'cos I found the language.txt is different in mine than in the download - & guess what's missing in mine ....

.....You guessed it 'Full hotkeys' and 'Simple hotkeys'

Dammit - If I knew that - I didn't have to HexEdit it earlier

Instead if you want to disable the real-time menu, it would be better to set a combination that needs to you press UP and Down, or Left and Right simultaneously, since that's an impossible input.

I'm testing Soul Silver (E) right now, and already I'm noticing that it plays a LOT better, there's no delay when battles start any more. Let's see if it can not crash though.

Did Soul Silver crash at all for you? I'm thinking of getting a SCDS2 and I'm looking forward to playing Pokemon on it.
