please help me understand the danger when using nsp forwarder zelda 64 games versus rom hack version using sm3das version. I know both are bannable just wanna know if theres any difference

Everything you install, thats not using an official game/title id will get added to your play history and be an instand flag for nintendo when the history gets send to them. Its also one of the reasons nsp forwarders arent supported officially by Atmosphere, since they just aren't safe to use.
Modding a real game on the other side will only be a problem if you play online with it, or install it from an nsp/xci.

by that definition rom hacks like sm3das with zelda is considered as modding right? so going by your logic its much safer than the nsp forwarder route right?
Yep, as long as the modding is not done in online games or done offline, it's mostly safe.
