And don't play pirated games in emunand one or on the emunand the that you use online.
Nsp's/xvi's should not be seen not heard by Nintendo
I don’t play backups on my OFW Sysnand, I only play them on my emuNAND that’s set up on the sd hidden partition. So yes if you used emuNAND for online which would have to come from a clean Sysnand then you wouldn’t want to use backups.

The correct answer: Yes, you can.

I play everything in CFW using Airplane Mode and stay offline in CFW at all times. (SX OS)
I also never try to open a pirated game in OFW, or launch homebrew in OFW.
I never update pirated games online. (CFW or OFW)
I only use XCI games to avoid pirated NSP games from being detected.
I create a fake offline profile to play my pirated games on, so my pirated save files aren't linked to my Nintendo Account.
And most important of all, if you're going to pirate a game and play it early, make sure you set your system clock/calendar to the game's launch day (or the day after to play it safe) so the save file gets created with that creation date, and not earlier. Save date creation is a possibility they look for to ban people, so it's best just to not take any chances.

Following all these rules I set for myself, I've never been banned since SX OS came out. I play Splatoon 2 competitively in Ranked Mode online daily in OFW.

Save date creation is a possibility they look for to ban people, so it's best just to not take any chances.

So having a completely clean official unhacked console, setting date a few days back and playing a new game to create a save could get you banned after you eventually go online? I really doubt that.

If you don’t ever install any pirated games and only use legitimately bought games, you’d likely be fine. I play my legit games online all the time while using CFW. But nothing is guaranteed
Its the same for me, I even play xci dumps including the cert from my games online in sxos, without any ban.

To my knowledge there is no trustworthy ban report for using atmosphere with homebrew only, since the day atmosphere includes a reimplementation of the sysmodules creport and fatal, to prevent the creation of crash and error logs.
So atmosphere without any installed nsps should be save.

I'm not completely sure about stock sxos, since I'm using atmospheres creport in sxos, since it's available. But my current atmosphere and sxos setups seem to be relatively safe, since I'm using them for nearly the full time they are available while going online with my cardriges and their dumps, without any ban yet.

Hey everyone I’m a total noob when it comes to switch hacking..I am going to try it out this evening. Just had a quick question, all the games I own are on my 256 gb as card because I bought them from the e shop. If I hack my switch will I still be able to play those?

Sorry to bump this, i have almost the same issue, i've installed emunand and used checkpoint to backup/modify pokemon saves, but when i try to open the game from my phisycal card it says "could not start software, try from home menu" i've tried googling around but cannot find a solution.

What do i miss?

Basically you can play online with unmodded unaltered legit games. if you go online with altered-modded-pirated games you will get banned. only way to be safe-ish is to use emunand for offline modding etc , and sysnand for online play. or you can keep sysnand offline at the lowest firmware saving fuses and create 2 emunands one for online one for offline if youre not hurting for space on ure sd card
wait how do I do that? emunand and sysnand are very confusing to me

You can if you setup emunand to do all the hacking stuff on offline while on sysnand you can play online just fine. Its mainly newcomers who try to play online with pirated games or never heard of emunand that get banned.

I plan to download pirated games on the emunand will that affect the sysnand/my chance of getting banned if I don't go online?

no the purpose of emunand is to emulate or be a separate copy of your sysnand. Meaning everything you do on emunand stays in emunand vice/versa. Nothing on sysnand will change or be updated from what you install via emunand. That way you can play online safely since your nand wont be dirty with piracy

Also once you have emunand setup your gonna want incognito installed too so that you'll never "accidentally" connect to Nintendo Services while in emunand. SXOS users already have a built in safe mode that works the same way.

yeah I plan to use 90DNS as soon as I get my switch

I think it's wiser to have both. As incognito and 90DNS are different approaches and one might cover something the other doesn't, or save you if one method goes bad (think of a configuration error in 90DNS etc)
