If your Switch is banned, you cant tranfer. If you use the same account, it wont be banned on the new one. It's just the system being banned, not the account. Nintendo isn't as strict as Sony and Microsoft

I suggest creating a new account rather than risking your new switch getting banned also. The chances are high if you have traces of piracy or modded files that was still logged on that old account of yours.

Nintendo's update 6.0.0 allows the user to activate the account on 1 system. Allowing you to play offline. And also accounts that aren't activated on a Switch, will still be able to play games and DLC. As long as the user has a internet connection always on. The game will stop if no internet is on. You'll still be able to play your games regardless on any Switch. Better cross your finger and hope you can activate the account on the new switch

he could just unlink his banned one from the web page to not just the console -

>Using a web browser, visit accounts.nintendo.com. Sign in to the Nintendo Account you wish to deactivate. Select "Shop Menu." Select "Deregister Primary console”

(also re-linking the account doesn't get you banned so ur fine)

I personally had Nintendo unlink my old switch (which was banned) and attached it to a new switch. I have yet to have any issues whatsoever.
