What if they wait until the release of online subscription and do a massive ban wave lmao. I would see that happening.
Please don't jinx it. That being said, this was discussed in another thread and it boiled down to whether or not the bank would be able to file the chargeback or not based on their investigation.

Basically, Nintendo would keep all $20.

I'm not sure what you're arguing here. We are pretty sure (maybe 95% sure) that the May 2017 banwave was caused by people using illegitimate applications.

The feelings are mutual, especially since I already agreed with that, twice. Three times if you count this post. Once again, I said it's not 100%. Just as there is zero proof that anyone has been banned for cfw alone, there is also zero proof that anyone has not been. I keep agreeing and never disagreed from the start that its likely the case. You're the one arguing here. LoL. Let's juts stop eh? Truce. It's not worth it man. :)

When have you EVER heard of a 3DS user being banned for merely using CFW? It is IMPOSSIBLE for Nintendo to know you're using CFW unless you use 3rd party apps like freeshop or FBI. Nintendo doesn't monitor every imput of your console, plus, detecting CFW on ANY system is a VERY hard, if not impossible, task to do

As long as you're no longer saying it's "100% speculation" that users were banned because of the use of illegitimate applications, since that's very likely what happened, then my job here is done.

Nobody has ever been banned on the 3DS for merely using CFW. People have been banned on the 3DS for using illegitimate applications, cheating online, and playing online with a game before its release date.
Maybe? I find it irresponsible to suggest it's going to be okay to just do what you want and there will be no consequences.

If you're talking about the Switch, I never suggested that. If you're talking about the 3DS, I addressed one aspect of the 3DS and acknowledged all sorts of other things that indeed have consequences.

Here's my (long-term) plan: don't hack it until I can afford a new, likely updated hardware switch. Transfer original content to new switch to maintain Nintendo Account and purchases. Then hack the other switch for emulator/Homebrew use without worrying about banning.
