Mainly the 3DS banwaves. It shows they are ready and willing. Part of me believes that was more about the Switch and what they were willing to do going forward anyway.
Nobody has ever been banned on the 3DS for merely using CFW. People have been banned on the 3DS for using illegitimate applications, cheating online, and playing online with a game before its release date.

I mean i cracked my 3ds long time ago yet nothing bad ever happened but again it wasnt in it early days.

Be sure to tell Nintendo that if they ban your switch.

That kinda makes it pointless having CFW.
Don't run any homebrew and cross your fingers that your piracy doesn't trigger a ban.

Stop. That is 100% pure speculation. To this day not a single person knows for sure what causes a 3DS ban. Although we DO know that unmodded systems don't (normally) get banned. Is it likely due to what you stated? Sure, but it's still only speculation.

I wish this could just be locked. It's a pointless question to ask. No one knows how, why, when for sure... but if you mod your Switch and then take it online you risk a ban. Period. End of story.

You can run homebrew without running illegitimate applications. By using Rosalina on the 3DS when using Luma3DS, you can run homebrew applications through a legitimate title, for example.

What I said definitely wasn't 100% speculation. We may never know for sure what caused some of the bans you're referring to, but we can be about 95% sure.

A software option for booting into RCM on 3.0.2 exists privately, but you shouldn't hold your breath. It probably won't be released publicly until long after the release of Atmosphere CFW.

As for physical ways, with a paperclip that's the right size, there's little risk using one bent how it's done in this thread: https://gbatemp.net/threads/paperclip-rcm-jig.502087/

We DO know what causes a ban. Using illegal software online. Just using CFW won't get you banned

There are indeed exploits that exist for 3.0.1-4.1.0 that allow one to boot into RCM without the need for a hardware modification. However, these exploits are private and are likely to remain private for awhile longer. The reason they are likely to remain private for awhile is because they aren't 100% patched in the latest system versions, and some people have expressed a desire to use these exploits to tinker around with the new hardware revisions that are likely to be released soon.

You are correct. There isn't a single confirmed case of anyone being banned for merely using CFW. Most of the banned 3DS systems from the May 2017 banwave had been regularly using at least one illegitimate application installed from a CIA file, and the rest had done something even more blatant.

What do you mean by illegitimate application ? Pirated games or what?

I mean an application like FBI or freeShop that isn't something Nintendo created.

These things can be run through Rosalina, and they will show up as whichever app is being used to disguise them.

Don't play online or don't hack. Pick one or the other.

But if you can't afford a second switch, and if you goal is playing online with pirated games, then you're always going to be at risk.
And that's a good thing, some pirates going online are ruining it for everyone else, so it's better for it to stay unsafe.

Before the early release of Fusée Gelée, both Atmosphere and Fusée Gelée were going to be released June 15. Now that Fusée Gelée has been released, however, Atmosphere will probably be completed and released before that.
