We DO know what causes a ban. Using illegal software online. Just using CFW won't get you banned

You are correct. There isn't a single confirmed case of anyone being banned for merely using CFW. Most of the banned 3DS systems from the May 2017 banwave had been regularly using at least one illegitimate application installed from a CIA file, and the rest had done something even more blatant.

Oh? Can you two point me in the direction to the actual evidence of this? I would like to know where the concrete proof of not being banned for ONLY running CFW is located.

SciresM has TrustZone exploitation on 3.0.1-4.1.0, but he doesn't want to "burn through" those exploits so soon for the reasons I've already stated. You can go back through his posts if you want.

Aside from pointing you in the direction of the informational threads from about a year ago, we can't exactly point to a negative, can we?

Edit: To be clear, what I mean to say is it's difficult to prove a negative. It's easier to point to people being banned than people not being banned. I wasn't banned and didn't use illegitimate apps, for example, but that doesn't demonstrate much without also pointing to every single person who wasn't banned and didn't use illegitimate apps. Instead, it's easier to point to the people who came forward about being banned and all of the illegitimate apps they were using. There isn't a confirmed case of anyone being banned for only using CFW, so it's likely that Nintendo banned people for using illegitimate apps. In addition, we understand that one was far less likely to be banned with SpotPass information sharing and Friends List information sharing turned off in the 3DS system settings. This also supports the idea that Nintendo was collecting information on application usage as a method for detecting CFW usage, so it doesn't appear likely that they could directly detect CFW. If you also look at the 3DS operating system and also how CFW works, there doesn't appear to be a mechanism in place that would allow it to detect CFW alone. There's nothing about the operating system that checks for the Luma3DS payload on the SD card or signature patches, for example. What we do see is a mechanism in place to detect which applications are being run and an ability to send that information to Nintendo.

I updated to play online, and I'm enjoying it. If what they say is true it shoulsn't really matter if we update or not before cfw comes out

That's the thing , some say if you are under 5.X you must wait and block updates and others say that its physical and the version doesn't matter. That's what have been annoying me recently in the switch hacking forums everyone has a different opinion and you dont know who to trust.

Rude? What are you even talking about? Sheesh. Some peope here are so overly hypersensitive it's sickening. Rather than easily saying "Sorry, I misread. I do see that you said RISK a ban.", you make some rude comment about ME being rude.

@Lacius You keep using terms such as "likely", "more likely", "less likely", etc. So exactly as I was saying. There is zero concrete proof. I already said that it's LIKELY that what you say is the case. Why are you arguing something I already agreed to?

I simply stated that modding will RISK a ban. That statement is absolutely 100% factual. I also agreed that using illegitimate apps IS likely the case, but that there is not 100 PERCENT proof. That statement by me is also 100% factual.

Yet I'm the bad guy who's being rude? Lmao. Whatever.

Here are the cold-hard facts:
  • The physical methods of running Fusée Gelée (and also CFW) are unpatchable on current hardware revisions. You will always be able to run Fusée Gelée, so if you're okay with using a physical method forever, you are free to update your system. Any reason to stay on an old system version is only about using alternative methods to using a hardware method of launching Fusée Gelée. That's pretty much it.
  • 1.0.0 has a public software method for running Fusée Gelée. If you care about that and other cool software methods of launching CFW, you should stay there.
  • Private software methods for running CFW exist and will probably be released in the nearish future, but they are limited to 2.0.0-3.0.0. If you care about those and other cool software things you can only do with these versions, you should stay here.
  • Other private software methods for running CFW exist but will probably be released in the distant future (if ever), and they are limited to 3.0.1-4.1.0. If you care about those and other cool software things you can only do with these versions, you should stay here.
  • The makers of Atmosphere CFW are working on emuNAND support, which will allow you to update your emuNAND and play with that without updating your sysNAND. This means if you're going to stay on a particular system version, you probably don't have to wait long before you can just update an emuNAND and use that.

I'm not sure what you're arguing here. We are pretty sure (maybe 95% sure) that the May 2017 banwave was caused by people using illegitimate applications. As I said earlier, not having concrete proof from Nintendo doesn't mean this is "100% speculation," as you put it. I discussed this topic a little bit more in an edit to one of my previous posts, so I'm going to put it here in case you didn't see it:

That's not what I said. I said, "The use of CFW alone might not be enough to be detected by Nintendo." Everything else I've said has been about the 3DS alone. I can't tell you what Nintendo might have in place to detect Switch CFW.

The answer is incredibly simple when it comes to asking if CFW/whatever other modification can or will be detected by Nintendo: no one knows.

You'll be at risk, though, period. There's no room to debate this. Connect to Nintendo's servers while running CFW or whatever else can probably be detected. Will Nintendo ban you just for running CFW and doing nothing else besides playing legitimate games? Maybe. Maybe not. Just because their track record with the 3DS was pretty poor when it came to banning systems, that doesn't mean they'll be the same way with the Switch.

So, as I said: no one knows. If you're looking for reassurance, it's pointless. Feel free to go online, you might get luck like most did with the 3DS. Or you may be banned. Either way, know the risk and know that no one here can guarantee you anything.

You'll be fine all the time Nintendo leave you alone.

If Atmosphere has any differences to Horizon then it can be detected. It's not released yet, but I believe there are differences planned to give extra functionality that is not in Horizon.

They could then insert something innocuous into horizon and the games themselves as part of the online session handling that tells them whether you're on CFW and then at a later data you could be banned.

You wouldn't be able to block it without disabling online play. You would have to wait for someone to hack every game before you can play it and have to wait every time Nintendo push out an update for the game. You wouldn't know if they'd managed to find everything as Nintendo could sit on the data for a few months before banning you.

I can't predict whether Nintendo will do it, but if I were them then I would.

Someone told me that i will need to buy a modchip if i update to 5.X+ . Also no idea for a approximate time for the software release on 3.0.2 ? if its more than july i guess i will just cope with the physical method hoping i dont fk it up.

Uh, sorry for interrupting this 'discussion' but I just want to add something. SciresM sole purpose for making Atmosphere is so he can hack Pokemon. And Pokemon is primarily a multiplayer game. And multiplayer nowadays are heavily online-based. Due to the fact that all firmwares have different potential entrypoints when it comes to hacking, EmuNAND support is also being added so you can play online regardless of your base SysNAND firmware. Now I believe SciresM is doing whatever it takes to make it as undetectable as possible so he can 6-0 everyone with his Bidoof, but it cannot be a 100% guarantee that it is safe to go online.

You will never need to buy a modchip. If you have a way of entering RCM and running Fusée Gelée, such as with a paperclip or 3D-printed jig, then you have a way to launch CFW when it's released. Depending on how the modchip works, it might make things marginally easier, but you definitely won't need one.

Doing dumb things like going online with a game before it's released, cheating, running illegitimate applications in a way that isn't obfuscated, etc. will likely get one banned on the Switch, yes.

You won't need a modchip on 5.X, you can trigger RCM and deploy the exploit using a PC or some other device with USB. You might want a modchip to make it more convenient.

Also no idea for a approximate time for the software release on 3.0.2 ? if its more than july i guess i will just cope with the physical method hoping i dont fk it up.

They are sitting on the > 3.0.0 exploits due to them being useful for hacking the new improved "Mariko" switch. Someone else might release one, but nobody has any real idea.

I'm crossing my fingers, and my toes, but I'm gonna hold out on Atmosphere for like maybe a week or 2 unless Nintendo drops an absolute must-have game in the next month.

Like Nintendo tried to stop the switch being hacked in the first place? Nintendo could use the switch security weaknesses to their advantage.
