and yet they don't go after temp (or me in general for the idea) for putting future sig patches on russian servers then again a lawsuit is meaningless towards me because you cant not you nintendo even trump if he wanted to collect SSI as lawsuit paymentd and i have no aditional income to go after not even a living trust

Well they could just email the inbox and Costello or Shaun have to decide what to do. They seem to be fine with the site as far as I know?

IMO, modded was practically asking for it. According to court documents, ninty initially approached him with a cease and desist. Modded allegedly agreed (including signing an agreement) to it and ninty would have left it (ninty specifically pointed that part out) at that. However, modded continued to sell all the offending stuff in contravention of the agreement......and well, ninty naturally went on the full offensive. Even worse still, it's alleged that modded was selling sd cards full of switch games and roms as well. One could argue the legality of the devices (mig, mods, etc) but piracy is an absolute no no. They even gave him a goddamn chance.

To be fair, ninty seems to be trying in that regard. They can't directly intervene but they can do so through their local partner in China, namely tencent. Tencent carries a lot of weight there. Something is also happening in China as evidenced by many MIG lisitings on aliexpress quickly disappearing.
Modded is the scammer? Some of these guys are something else..... If I was handed a cease and desist by Nintendo I would probably never even utter the word Nintendo ever again in my life. Big corporations are not to be messed around with.

I do wonder/ worry if or when they will get round these here parts...

Once they run out of legitimate targets, the 'tutorial' and scene news sources maybe next. I believe they will stoop that low eventually.

The moderator part is probably just a footnote in the lawsuit. But then again, a mod openly boasting on his subreddit that he has pirated many nintendo games and has no intention of ever paying for them is probably not the best way to go about it.

It's a minor point but it just serves as more ammo for ninty since it's practically free ammo served up by him. It's harder for him to feign innocence/ignorance.

I like how people who have never been to China or even Hong Kong like to talk smack with no idea how it actually is there. They tackle straight-up piracy quicker than you seem to think, when a formal complaint is made.

I used to visit Hong Kong nearly every year (before China took it back) and half if the Golden Arcade was shop after shop of pirated DVD movies, music, and disks loaded with hacking tools and cracked commercial software and games. But even before China took over, they cracked down on it HARD. The last several times I’ve been there, none of that was anywhere to be found. Modchips and such, yes you could find them. Pirated software and movies? Nope. If still existing, it went way underground.

Point is, don’t think for a second that Nintendo can’t make things happen there. At least for copied/ripped games…

So they put roms/isos on the sd cards? Well, like 100 others on consoles/handhelds listed on Amazon. Sure, 100 people do this, makes it not legal, but i wonder why these dodgy emulation handheld/consoles with 10000 games are still on sale on Amazon.
But all in all, if nintendo warns you... And you keep on selling. What can you say? They deserve it for sure.
I hate nintendo, but in this case nintendo did the right thing.

Then why are the millions of stupid famiclones with preloaded ROMs still constantly being sold everywhere?

To be clear, famicon clones (the hardware itself) can be legal as some of nintendo patents for it have expired. But the roms are very much still under copyright protection.

Nintendo could be trying for all we know but those things will forever pop out just like piracy sites. There are always plenty of new piracy sites distributing their games popping up despite the best efforts of nintendo to take them down, does it make it legal then? If it were, gbatemp wouldn't have been called what it was in the first place.

And even if nintendo wanted to do something about it, they might not be able to due to different jurisdictions while the two being sued in this instance are located in the US. For example, Russian authorities would likely ignore legal demands from the west or those they deem to be "aligned" with them.

It does make sense, but Vimm's lair only had Wii and older ROMs and Nintendo still took it down.
And how does all these clone systems get their games? Yepp from online. Also Nintendo wasn't the only one going against Vimm's lair. The biggest of them is the ESA. You don't mess with the ESA since they got unlimited funds

if i was (a one term) president I'd change the DMCA and label the ESA as orginized crime if not a terrorist orginization then again if you know who had his way and made the USA autocrat well game over (pun intended) for these bullying tactics by the esa and other game companies
