So i have 2 dsi's (one has already been modded with unlaunch so it has hiyacfw) and the other has no dsiware and i cannot have it hardmodded
the 2nd dsi (the one i want to mod):
- has no dsiware
- has firmware ver 1.4.5E
- has everything working as intended
- reads my flashcard perfectly
Is there any way to mod this dsi? (i have already stated, i cannot use a hardmod)

Did you buy this dsi used?
If you did, you might want to go to the dsi shop and check for redownloadable titles. Tickets aren't deleted with system formats like they are with the 3ds.

I did that with a recent dsi and it had 5 games on it!

But the DSiWare Shop was closed. Can you redownload games even if they're unlisted (as all content in the DSiWare Shop is)?

While the dsi is second-hand, no games seem to have been installed on it before, the only option is 3ds transfer tool.

No, you're not looking in the right place.
DSi Shop -> Start Shopping -> Settings -> Titles you've Downloaded

Looks like I'm in a similar situation. I have a beautiful dark red DSi XL that has no DSiWare installed. It's in Japanese too and for some reason I can't connect to my wi-fi with it (says something about security settings).
