Frogminer is coming/released, so I was wondering if I could hack my cousin's 11.8 new 3DS with it.

No, you won't get banned. The only security feature added was checking tickets installed in sleep mode, which is no longer a concern because freeShop can't even access the servers and thus this security feature doesn't matter.

The risk of getting banned does not increase with 11.8 and you won't get banned for using FBI.

In case you didn't get what Lilith was saying, you will NOT be able to download games for free directly from Nintendo through FBI. If you're talking about installing them with a QR code or direct URL of a CIA, then that'll work just fine.

Sorry, I have been out of the loop for a while, was the 11.8 Piracy check where it sends tickets to Nintendo only on download cdn? I thought it backported the feature where it sends on game launch?

No, backporting the Switch's AP checks was a wrong assumption that was made shortly after the 11.8 update.
The tickets are only checked when downloading the game.

The ones that sent console info were only sleep mode downloads on freeShop (aka using the NIM module), so it still exists, but you can't trigger it because freeShop couldn't even access the servers (as Lilith said).

And no, they aren't checked on launch.
