All current reports are being made on 5.X because its the latest firmware. The biggest reason I postulate that there are no bans on 4.X is because when it was the latest firmware, there were no hacks that could be performed on it. Now that we do have hacks for 4.X, it is not the latest firmware anymore so people cannot be banned for being on 4.X. After all, you cannot check if you are banned or not unless you're on the latest firmware.So are all bans 5.x+? Did a quick check and it doesn't look like there are any 4.x bans. Or am I mistaken?

Hmm, this thread isn't really supposed to be a "How to avoid bans" type of thread. Its more of a "How are people being banned?" kind of thing. There's actually a thread in the tutorials section that details a lot of ways to mitigate bans so I feel less of a need. Maybe I ought to post a link here for completeness' sake. This is the first time I've ever seen someone so reckless and not be banned. I've seen some people do the complete opposite of this and get banned. Urgh, the frequent buyer theory sounds bogus but it does explain a lot of things...-snip-

Additional Comments: As you can see, I constantly go online while using hacks and layeredFS (only for odyssey mods which disable online for the game, I was accidentally online with an old version of the hacks though) and I also use emulators and get crashes often too. After all of this, I believe that the frequent buyer theory is true as I have bought SEVERAL games (16, not even including DLC) and extra controllers, and at the same time have done nothing to cover my tracks. I seriously think that the theory has some weight built into it, especially seeing as Nintendo MAY (unlikely) also spare users who don't cover up their tracks well as they can confirm they aren't using any illegal stuff.
