man if you check out the comments on some of these articles the people are in the middle of the homebrew scene, but mostly negative

Demonize something you don't understand or movements that you can't take part of. It's all the same with people regardless of context. Homebrewers, Pirates, Hackers, Tinkerers, Cheaters, and Thieves, it is all the same to the uninitiated.

been like this since the wii era so nothing new than. and it's rule number one you hack your console and go online than your at risk from this hapening :P

Well, if a ban wave rolls out, these are the same group of people who will be moaning that their second hand Switch is banned. The same people they want banned won't give a hoot about selling their banned console to some poor sucker.

Then tell me please how they can ban an unhacked console because he hacked another console by tracing his account to multiple units and banning them all because of what he did on another console ? How do that gives them to right to ban an unhacked console ?
It's unclear how they identified the second console, but irrelevant as long as they did nothing illegal (they could have just identified any console that connected from the same IP address at the same time as any suspicious activity on the hacked console). As for what gives them the right to deny access to their online services, maybe you should check the terms and conditions and user agreements for those online services.

Yup, that is the case.

I love threads about homebrew on ResetEra, I love all the hate agains hackers/modders/pirates that is spread there. Some people over there would probably stab you 20 times in the stomach with a knife given a chance, and would justify it the same way as if they were defending their families. Crazy world we're living in.

I checked and it doesn't state that anywhere, it only states if you break the guidelines and so forth that particular console will get banned. If they ban multiple consoles even unhacked ones wich wasn't the case with this person seeing the last news about this then they are banning you as a person and not the console itself.

As I see it, let them continue to speak hate on us, after-all we don't owe them anything, and never will.. they can continue to waste their time on us if they want, but we should instead worry about indulging ourselves, and if we can then provide works of our own to contribute more to the scene's growth, if not for us/yourself then simply out of spite for those against it ;).

I'm not sure why you don't understand why it's not within Nintendo's remit to do this (you even suggested their actions were 'above the law'). The servers are Nintendo's property and it has the right to allow or deny access. They have a right to protect the integrity of their systems and, if they suspect you of hacking then banning only one of your consoles is a half measure. To imagine that this could cause them any kind of legal problem is absurd.

So if you previously hacked a console and then refuse to do so anymore in the future but they know it is you that did it in the past gives them the right to ban your new console ? What bullshit are you spouting. I hope you do know how absurd that sounds. It clearly states in their EULA if you hack that particular console you can get banned but if you buy a new one and won't do it anymore then you are not breaking any laws or EULA or whatever and they don't have a right to ban your unhacked console. Stop with that Nintendo social justice warrior behaviour please defending them all the way constantly

What!? Of course they have the right to ban you if they know that you've hacked them in the past. You clearly need to familiarise yourself with what rights you do and don't have, and what rights corporations do and don't have.

Side note: where the fuck is the facepalm emoji?

Lmao no they don't. I advise you to read the EULA and point me where it states that they can ban you over the whole network and every console you own. Please do so. I've read it and it states that they can ban the console you're using and only that specific console. I advise you read it. I know what rights i have and it is clear you don't with the social Nintendo dick riding behaviour. People like you are the cause the industry is the way it is today. The EULA clearly states everytime ''The Console'' meaning the console at hand and it doesn't state account or consoles. Note '''the console'' part below ;). Don't see anything that has to do with account banning all systems you own, even unhacked ones.

Your rights under this Agreement will immediately terminate if you do not comply with any term of this Agreement. At the time of any termination of this Agreement, you will immediately cease all use of the Console. Our failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of our rights.

Why don't you point me to where it is codified in either European or American law that a company legally has to grant you access to its online services? The EULA for the Switch does not cover access to online services, so I don't think you have read it otherwise you wouldn't be making stuff up. I advise you to read it to prevent further embarrassment.

Nintendo does not have to grant you any right of access to its services from a Switch console and can ban anyone they like for any reason at any time. Nobody, especially not a court of law, is going to have sympathy for a hacker whose "non-hacked" console was banned.

I gave you a statement from the EULA that shows i am right and u are wrong and you keep defending your point without anything to back it up. Please back up your statement like i did wich clearly shows that the console will be banned and not multiple consoles.

You edited that in afterwards, so I didn't see it, but let's review it shall we?

Other than being a stupid statement, this has nothing to do with online services (specifically the Nintendo Account service) and is only to do with the console. It's basically saying, 'If you breach this agreement, you may not power on and use your device anymore,' and , 'If you do power on your device and we do nothing to stop you, that doesn't mean that this agreement is null and void.'

It clearly says the console at hand, it doesn't state anything about multiple consoles

Correct. (WHERE IS THE FUCKING FACEPALM EMOJI!?)

Nintendo have not blocked use of the console, they've blocked access to online services. They're not invoking anything to do with that clause in the EULA.

I know what rights i have and it is clear you don't with the social Nintendo dick riding behaviour. People like you are the cause the industry is the way it is today.
This is not me riding anyone's dick, it's me calling out bullshit on a forum. People like you are the cause of other people thinking console hackers are childish morons who do it to get free gaems by following step by step instructions on the Internet. You have absolutely no idea what rights you have and your sense of entitlement is showing your (mental) age.

Jezus christ, back fucking up your claims. I'm done with this Nintendo dick riding behaviour. Have a good one
