Yup, that is the case.

I love threads about homebrew on ResetEra, I love all the hate agains hackers/modders/pirates that is spread there. Some people over there would probably stab you 20 times in the stomach with a knife given a chance, and would justify it the same way as if they were defending their families. As I see it, let them continue to speak hate on us, after-all we don't owe them anything, and never will.. they can continue to waste their time on us if they want, but we should instead worry about indulging ourselves, and if we can then provide works of our own to contribute more to the scene's growth, if not for us/yourself then simply out of spite for those against it .

The servers are Nintendo's property and it has the right to allow or deny access. They have a right to protect the integrity of their systems and, if they suspect you of hacking then banning only one of your consoles is a half measure. To imagine that this could cause them any kind of legal problem is absurd.

I've read it and it states that they can ban the console you're using and only that specific console. I advise you read it.
