I'm not sure why you don't understand why it's not within Nintendo's remit to do this (you even suggested their actions were 'above the law'). The servers are Nintendo's property and it has the right to allow or deny access. They have a right to protect the integrity of their systems and, if they suspect you of hacking then banning only one of your consoles is a half measure. The EULA for the Switch does not cover access to online services, so I don't think you have read it otherwise you wouldn't be making stuff up. I advise you to read it to prevent further embarrassment.
Nintendo does not have to grant you any right of access to its services from a Switch console and can ban anyone they like for any reason at any time. Nobody, especially not a court of law, is going to have sympathy for a hacker whose "non-hacked" console was banned.

Other than being a stupid statement, this has nothing to do with online services (specifically the Nintendo Account service) and is only to do with the console. It's basically saying, 'If you breach this agreement, you may not power on and use your device anymore,' and , 'If you do power on your device and we do nothing to stop you, that doesn't mean that this agreement is null and void.'

Nintendo have not blocked use of the console, they've blocked access to online services. They're not invoking anything to do with that clause in the EULA.
