What do you mean by the "then start looking for exploits"? Literally all exploits (except perhaps 1-2 very minor ones) have been found by now, just haven't been released or worked on because there was no need to... You should not try that in the EULA there is probably something stating this is illegal(why wouldn't they), and pull you to court.Whoever does that would probably become a millionaire overnight. At least before nontendo shuts them down.

In all seriousness, I do wonder if this would be possible. I develop games as a hobby, maybe I could somehow get a 3ds developer account(if that's what it's called), and throw it on the eshop.
