And what if someone who reported the was a hacker who found it? So that they could tell Nintendo, so that Nintendo would patch it, so that they could release the PoC?

Yeah, the "emulation isn't piracy" discussion got a lot harder to justify since Nintendo introduced the Virtual Console. It immediately negated the major "BUT Nintendo don't sell or make money off of these games anymore!" argument that most people use.emulators (still warez in 99 percent of cases, but somehow more "okay" by some people's standards)
