If you're playing .cia files installed through Luma (or any CFW really), you will not be banned, unless you are playing a game on your system online before the game is officially released. This is why there was a large ban wave for Pokemon Sun and Moon players, these people played the game online before the game was officially released, making it clear to Nintendo that those people had pirated the game.

Why is it that you won't or can't get banned? Is Nintendo really that incompetent?
There's no way to tell the difference between a game installed with an installer and a game bought and installed with eShop.

If you download any game with a homebrew that downloads them directly from Ninty's servers you'll never get banned from playing online, since their servers don't host leaked or otherwise patched games.
Luckily we have a wide selection of homebrew that do just that, so just get one of them and use it to get games.

Thanks for the replies, but I'm still not sure WHY exactly it is the way it is.
Don't they use anything to check the buyer's NNID, console ID, if you actually (could) have bought it?!

No. There's no way for them to know what is on your console unless they physically had it. freeshop downloads titles straight from Nintendo's servers. Anything you install otherwise they will have no way to know. You're safe on A9LH+Luma3DS.

ok so, private headers are only for online play with a flashcart?
Private headers are specifically for cartridges. So when you use a flashcart, it looks for a private header. If the same header is used on multiple devices it gets flagged. When you install the software to the system it doesn't require a private header and uses the system for its header, so there's no risk of it being used from multiple places at the same time.

I rather enjoy a life of taking it easy. I haven't reached that life yet though.
