Right, so Nintendo(official store) has dispatched my UK copy, which means it should arrive tomorrow, does that mean it should be completely safe for anyone with an EU copy to play from tomorrow? As it's Nintendo themselves that have given the copies out now.

They are breaking the street-date then and Nintendo will still ban you as they have done in the past few days.
Didn't matter how you got it, if you were online when you shouldn't be able to, then you got banned.
If you got the game in a legit way and if you can prove that, then you can call Nintendo to get unbanned.

Officially, they should NOT be selling those games. Everyone who's bought the game is likely gonna get banned for having it early.

I don't think you're understanding her/his point. They may be selling the copies early, but you that still doesn't mean you should connect with the game early. That's why there was a reviewer that got banned for playing early.

they didn't really break it cause i asked micromania they said they got Nintendo France authorization to sell it today. And i believe them cause they got the game yesterday night but they refused to sell it yesterday because " Nintendo told us we can sell them from 18th"

You went to the eshop with a digital copy that has yet to be released in your region.

Im basically zero when starting to lurk here on this thread since im banned. But thankfully my console did system transfer before and that movable.sed and localfriendcode method totally working !!! No more 0102 ban ! Thanks GBATEMP ! Hopefully u guys figure out more versatile method for others.
