not always, but in the 3ds scene I would. Devs in this scene are spread out and work independently, which means you never know what will be released, when, and for what fw/device. Another issue is the amount of time it takes for things to be released. It took two+ years for the first hints of running unsigned code, and then it was limited to 4.x. Unlike other game companies you don't need an update to use online features with games. The only feasible purpose for updating is eshop access, which becomes irrelevant when you have signiture patching. As far as we know, some devs may already have the same access on 9.5-9.9 as we do on 9.2 and lower, and it just may have not been leaked. Which I have seen happen as I said before with pasta. It just makes more sense to me to wait it out. But then again it comes back to priorities.
