I think you need to update emuNAND or FW spoof.
FE needs 9.7.0.
XB needs 9.4.0.

Since it works with Gateway, I suggest trying with BootNTR. I'm on 9.2 N3DS, so I can't say with 100% certainty.

And, is sysUpdater_0.3 safe to use? I can't find any v0.4.1 cia file

Install Cubic Ninja as a .cia and use Ninjhax 1.1b to run the .3dsx version, if you can't find the .cia.

I already told you to use BootNTR.

Is there a fix for the non working 3D on n3DS?
Always have to close the case and reopen to get proper 3D.

You should already have booted rxtools in devmode, then running sysupdater from the Ninjhax menu. The GitHub has a warning about not having permissions as .3dsx, but if you are already using rxtools to run Ninjhax, then Ninjhax already has the permissions it needs. You don't have to do it that way, it was just an option to consider.

rxinstaller.nds are stable now.
But I would use themehax instead of MSET. It is extremely convenient and simple.

1) Download latest rxTools nightly and put files into sd card.
2) Put this .3dsx into /3ds/rxTools http://www.mediafire.com/download/ydvv3aa3mk1kuy7/rxtools.3dsx
3) Install themehax via browserhax http://smealum.github.io/3ds/
4) Turn on your 3ds with L button pressed.
5) profit

And? I'm not talking about the NTR CFW, I'm talking about BootNTR. You install it as a .cia as well, then run it before trying to run your game. Much like the freemultipatcher.
