If you send your n3DS in for repair they will replace it with an updated refurb.

That is a really bad idea. 9.0 n3DSes are getting hard to come by and that would be a downgrade.

Not in the store I purchased it, they said they will observe it for a day and SMS me tomorrow if its covered by replacement (it better be, its a factory defect, i paid 100% for that sht, i expect 100% quality) haha, but anyways, they just replace it by another one right off their shelves, I have a list of serial codes handy on my smartphone so I'll check the firmware version of the replacement.

With CFW or Gateway, yes you can. You'll need a .cia manager such as BigBlueMenu - Devmenu - FBI. I personally use BBW for everything.

If you're going straight into cfw without a gateway cart, you'll need to:

*Backup your SD card*
Install Ninjhax to Cubic Ninja v1.0
Launch Pasta CFW
Ninjhax again from Pasta CFW
Launch FBI from homebrew menu
Install your .cia manager of choice (installs to sysnand)
Format Emunand
Restore your backed up files to the SD card

Now you should be good to go, when you created a new emunand, it should transfer the installed .cia manager from sysnand over to your new Emu.

Thanks! Do i need to worry about these things called signatures and such on GW EmuNAND? and which is recommended to be Formatted to unlink Sys and Emu, the SysNAND or EmuNAND? (having unwrapping issues) Thanks!

As far as i'm aware, every cfw should have signatures patched now, if you're using a gateway cart, you don't have to worry about them either.
For unlinking: turn off the 3DS - Remove internal SD - Turn on - Format Sysnand - Turn off 3DS - Insert internal SD - Turn on. That's about it. *Formatting sysnand will remove Mset exploit if installed iirc, so you may have to redo that if you have already installed it.*

Currently, any game that's going to have 9.6+ encryption; which locks out N3DS users currently.
For games like The Binding of Isaac which is N3DS exclusive, it requires someone to get the game on an up to date sysnand, that also has a hardmodded N3DS so they can revert back to exploitable FW.

I used puzzle dragons rom via gateway mode (dpad and up) and updated emunand to 9.5 that way

So EmuNand can be updated with BBM? I updated SysNand before, and the requirement is PASTA CFW/Rxtools Devmode with sysupdater (BBM will result in a brick).
