Depends on how they are blocking....if its because the same header is showing up on multiply systems at the same time then yes. IF its dude to header mismatch then nobody is safe unless they dump their own rom and use that games header...but that is more easier for a GW user then sky.
Headers are so easy to make, especially with a GW handy. I'm surprised many people still use public headers at all. I'm using my SSB header but thinking of changing over to OoT or something since it doesn't have online at all and will always be safe.

I think they are just taking potshots and seeing who gets hurt before the ban-wave.All flags are pointing to public headers being the problem rather than mismatch. Obviously it will take some time for the dust to clear but for the time being I'm fairly confident that the issue lies within 2+ players using the same header and going online in the same instance. Otherwise there would be a lot more people having issues at the moment.

How is that an assumption? Let's say my SSB valid header for some reason becomes banned, then that means my valid kart can't play online ever again on any system and I would have to dump to ROM with a different header. Since OoT doesn't have online, this header would be fine to be banned from online play. Seems like sound logic to me.
System transfers and formatting require your NNID to connect the the Nintendo service. If it's banned you cannot do this. Your NNID is now locked to the system unless you can find another method of removing it.Probably.
Is the Ban by NNID? If so, can't you do a system transfer to remove that NNID to a new one? If you can, someone can probably edit the NNID of the emunand quite easily and test it out. Not that I know, I'm not a programmer or anything.
