Hacking Xbox Live question

My cousin lended me an Xbox 360 that has been modded to play burned games
I don't want to play online, But I do want to recover my gamertag and download my Fable III DLC's and free content.
Can I do this without getting banned? I believe the Xbox dashboard is fully updated (2.0.13416.0)
It isn't J-tagged or anything, just to play burned games
I have the actual Fable 3 game and everything.

if you have your first xbox you can port the data using a usb stick. If not then it is ok, Microsoft catches you when you play a game that isn't stealth patched which then let's microsoft sees that your playing a burned copy of the game.

So i can plug it in and download/recover gamertag? I would just get it from the other xbox but it's 75 miles away, haha


edit: it says it needs a system update, and I'm pretty sure this nulls the mod right?
I don't want to take any unnecessary risks
