I might be wrong, but I thought Wii backups were decrypted anyway, so not 100% exact copies of the original... so if Nintendo found a way to detect altered games, I think it would have an impact on "normal" releases just as well as on scrubbed ones.
Anyway, yeah, scene rules are sometimes stupid. But who cares? THEY are the people who provide you (though unwillingly) with games, music, whatever... so I think anybody who uses or has used their releases should be grateful.
Besides, they only represent the first stage of the whole process of games ending up on your computers... so torrent trackers, usenet posters, etc. are still free to scrub the releases if they want to (and they should do so, IMHO) before they release them to the public.
