It kinda looks like your bottom screen is IPS, but as far as I know, no n2DS XLs have IPS screens.
i dont think its software related. i too have the that New 2DS compared to older handhelds Nintendo have made, its not the best build device. mine has problem with the shell and i no idea how i got it.
