Just putting this out there also, but I'm pretty sure the reason why games like Cubic Ninja and FreakyForms Deluxe aren't patchable is due to the developers going bankrupt (At least, I know this is the case with Cubic Ninja's developers. Not so sure about FreakyForms.)

Because the people who made the coding and were capable of making patches aren't in a position to do so anymore, this allows the exploit to run free and become a big thorn in Nintendo's side. At best all they can do is attempt to pull stock from retail stores and eShop, ban sales of the games in retail stores and attempt to patch it through external means a la the randomizing feature from Home Menu.
