I have my New3ds and my brother have his old3ds. I don't want to inject my LFSC into his 3ds.

There's another thing that you can do, although it is even more risky as far as I know (AFAIK), and that is editing the actual console data using NTR so that you can play online. The annoying bit is that it requires NTR CFW, which then has to be applied at boot each time with the patches again or a non-accepted pull-request of luma3ds. Instead, I recommend you keep him banned. He was the idiot in this situation, let him feel the damage. (In my language we actually have a saying based around that "Wie zich brand moet op de blaren zitten*". It means that you have to suffer the consequences of your own mistakes. It's an old saying (not much used anymore AFAIK) but it fits perfectly in this case.)

* Rough english translation: Who burns themselves has to sit on the blisters. Beautiful Engrish when you try to translate a saying.

But some people do use Pokebank. My boyfriend's 3DS got banned (because he didn't listen to my warnings and went online) and now he can't get into his Pokebank

Also, the perma ban restricts more than eshop, it's basically all NNID content. So if those get a new 3DS with firm >10.7, that means you can't sys transfer so hardmod is only option (as of now).
