Hacking System transfer without update possible?

Hi, i have a 3DS in 8.1 and a N3DS in 9.4, i would like to system transfer my 3DS to N3DS because my 3DS has GBA and NES game (Ambassador program), but it tells i need update.

I have buy a gateway and i want keep my gba and nes game.

Yeh emunand. Be sure that it says GW 8.1 then you select update.
How ever I'm not sure about the games save data. It didn't restore mine.
Well I did from 9.4 to 4.5.
