They'd have to recall all sealed, unsold units just to update their firmwares. Not very convenient. The console still asks for the update as soon as it's turned on and connected to a wireless network, but the firmware it ships with is inferior to 9.0.

Well crap. I'm gonna see what I can do to get a 2DS in the meantime, then!

Oh really? Why after it's put to sleep? Does it actually download the update while it's sleeping and it only prompts you to update when you open the console?

nope im guessing while its in sleep it downloads info from nintendos servers telling that there is an update.

That's freaking evil. It's so easy to accidentally press A just to make the popup go away.

Press B to cancel the update. Then boot recovery to get rid of that nag. The nag will come up every 24 hours on first startup. If you let other people use your system remove it ASAP so no mistakes happen.

There ought to be a law against that. Can't modify your system without your authorization.

There are much bigger concerns that I want our government to focus on than updated systems.
 
I just use the tubehax DNS. Works for me :P

I think it depends on the game. From what I know, games like Smash only check that the game is at the latest version - not the firmware. So you could theoretically have a 9.9 3DS and still be able to play Smash online - because Smash is up to date but the 3DS is not.
There may be games that check for firmware version but I don't know of any.

Thanks for the info, because I actually have a 9.9 2DS with Smash Bros just like you described xD

Just disconnect your Wii U from the internet and you will be safe from updates

That may be easy for you to do but not for everyone. Online makes games fun even for the kids. The best route to go is to find a cheap Wii U and use that as the updated console. And you can keep your other one offline. Best of both worlds once the Wii U scene gets more interesting.
