They'd have to recall all sealed, unsold units just to update their firmwares. Not very convenient. The console still asks for the update as soon as it's turned on and connected to a wireless network, but the firmware it ships with is inferior to 9.0.

I think it depends on the game. From what I know, games like Smash only check that the game is at the latest version - not the firmware. So you could theoretically have a 9.9 3DS and still be able to play Smash online - because Smash is up to date but the 3DS is not.Wait guys is it normal that I can play online without updated firmware?

There may be games that check for firmware version but I don't know of any.
