To take your statement out of analogy and bring it to actual terms:
"That's like going to a place where copied games (alcohol) is banned and asking them to stop banning homemade games (homemade brews)."

Actually, according to Nintendo Homebrew = Piracy.
Remember, these companies get their main profit from commercial game sales, not hardware. You people are going around making games for free, then Nintendo can't take a cut of the profits (as there are none), which to them is the same as losing money.
 
How exactly could Nintendo block piracy without blocking homebrew and why should they go to the effort of working that out?

They can't it's too late for that, too many pirates know how the DS works and how to trick it into loading commercial games from flash carts. If Nintendo had thought about it properly from the beginning, they could have had some sort of sandbox to keep homebrew away from the actual hardware in the same way as the 'other OS' feature of the PS3. The PS3 'Other OS' feature went a very long way to preventing piracy because with it, there was no reason to hack the console. If homebrewers could code for the DS from the beginning, there would be no reason to hack the system in the first place.

It isnt to late for nintendo to stop homebrew on the DS, theyre just to lazy to actually work those cards out and make a good enough patch to block the cards, Sony on the other hand as you know stopped the homebrew in 1 WEEK, nintendo wasnt even close to stop it 13months after 1.4. Also i have to admit that the "Other OS" was a pretty smart idea of Sony.

That isn't what I said. It is too late to stop piracy without stopping homebrew. Allowing homebrew at this stage would be a big OK to pirates because the early hackers figured out how to load commercial games (by hand, not by hijacking firmware), so if they allowed homebrew, it would be used to load pirated games.
If however, there was a similar option to what the PS3 had, the piracy problem probably would not have happened so quickly.
