Hardware Stock Firmware Version for Brand New (new) 3DS XL?

So I'm looking to buy a new "new" 3DS XL from eBay but the seller states that the device has already been wrapped up for postage and so that they wouldn't be able to tell me the manufacture date or the firmware version. I'm currently not sure if I want to proceed with the purchase given the fact that I heard from someone that if any 3DS XL consoles were manufactured after 9th May (11.0 update) that it would be updated to the latest making it difficult to hack. Is there any validity to that?

I am not aware whether the statement about the installed firmware in newer devices holds true, but downgrading from 11.0 in general isn't exactly hustle-free:
