Sony is doing right... they are just protecting their Market... don't complain if you hacked your PS3 and got Banned. Hacking the PS3 and using Pirate is illegal at the 1st place...

i hope Sony can win over the Pirates =)

oh, wait! Let me quote something u wrote not so long ago QUOTEWhy does My Cheats does not work for Golden Sun Dark Dawn? using M3i Zero with latest Sakura...

so hacking a DS and even using cheats is ok, as long its not for the PS3 *lol

2. u should not get banned for using a hacked firmware and playing legal backups on PSN, right? Because thats what Sony is doing.

Ya know, they start getting innocent people banned this could become a serious problem for everyone...

Sony needs to just stop banning people :/
No, they don't.

I can even agree with hacking a console, but PSN isn't something CFW users have a right to have. If you're using CFW, stay away from these services. Sony has all the right to ban these people.

so if Im playing a legal copy with my CFW I should get banned, thats ur opinion?
Yes, that's exactly this. Even if you're not using cheats or anything. Sony has the right to keep you away from PSN.

Well, maybe in Brazil, but not over here in Europe.
So Brazil must be an eldorado for Companies like Sony and Microsoft.

anyway, I would love to hear your explanation, how it can be legal in Brazil to ban people from a network, because they made a software modification on a piece of hardware they bought.
Its like Microsoft saying: "u can only use ur PC with Windows, if u install as your second OS Linux, ure a bad customer and we will stop to provide support"
or an Telecom saying: "U can only use our Network with an "Vodafone/Orange/O2/T-Mobile etc." branded Mobile Firmware, if u install on ur Device android we will ban u."

nevertheless I understand if Sony blocks people, for using copied games.
But everything else is, in Europe and in my opinion, not legal.

"your opinion" does not constitute law. And regardless of your location, you agreed to the PSN TOS which explicitly states that Sony reserve the right to ban you from their services if you use any unofficial or unlicensed software or hardware, including "circumvention devices" etc. So yeah, you AGREED to that when you used PSN for the first time (and probably several more times after that seeing as they keep updating it). It is nothing to do with the law really. It is to do with the provision of a service. For example, with a warranty. Generally, a warranty will be void if you were to say, pour lighter fluid over a device and ignite it, then smash it repeatedly with a sledgehammer. i.e. you violate the terms of the warranty were is says something along the lines of "not valid for deliberate damage to device". They have no legal obligation to continue to provide the service (warranty), because you voided the terms of the agreement. Same thing here. Stop complaining. Just because what you are doing is legal (no laws I know of against burning your own property [safely] or smashing it with a sledgehammer), does not mean that any service the manufacturer usually provides must legally be available to you. And yes, it is the same thing.

Second, its not true what you say and its not only my opinion but our laws.
Even if I would agree in it, Sony is not allowed to force u for anything regarding ur property.
I remember Microsoft doing it with Flashcards for the 360. They banned Flashcards from Hama, Hama went to Court, won, and got a lot of Money from Microsoft, so they agreed to stop manufacturing this cards. Not very cool of Hama, but hey!

BTT: As Sony is forcing this agreement, in front of a court they would not have many chances, as long as u can prove u didn't play a copied game.
Its like agreeing in the Sony Rootkit of 2003, u had to agree on it, but the end of the Story was that Sony had to remove it and to pay a lot of money over here in Germany (BMG had a least).
Besides, in France, Italy, Germany and Sweden u can, for example, make 5-10 copies of your CDs and give it to your friends, as it is ur property... just an example.

This might just count on the European Continent, not in England, but Im pretty sure, we have around the same laws.

Well, so it's shitty to be a company on your country. =P
If I had one, I would not even bother be on your country.

Anyway, AFAIK, Sony can ban anyone they want from their services (PSN). You can still keep playing offline with your modified console.
If this is illegal, I sugest you/anyone from your country on this situation to sue them and see if you would win. =)

You would be stupid if u wouldn't, as in Europe people earn not that bad (Nintendo knows, thats why 250$ got 250€ fot the 3DS) and the Market is gigantic.
Wanna check how many people bought an DS,Wii,360 or PS3 in Europe and compare it to South-America? =P
Oh I heard the PS2 came officially last year to Brazil, how is it

Im surprised, that u living in a country, where on every street Corner (at least in Rio) u can buy copied games, are such a fighter for the big companies.
Well, let me tell u, it happened a lot that people won in Court against companies, not only over here in Europe =o)

Just because my country has a lot of people who think piracy is right, I would be like most of them. =)

Of course I said your country, not Europe. It obvious Europe is a great market for games.

Sony are perfectly within their legal rights to withhold their service from you. They cannot stop you doing something if you want to, but they can perfectly well stop access to their services. Regardless of what country you are in. That is the truth of the matter.

I would love to see what laws this is violating in EUR/Germany. Please enlighten us.

Yes, you may be entitled to do what you please with the hardware, but you are not in any way, shape or form entitled to use of PSN while doing so. You agreed with the TOS multiple times, and in doing so, you agreed not to use CFWs and Jailbreak dongles on your PS3. You violate that, and you get banned. Simple as.

MS doesn't even give a warning, so there you go.

Oh, and as far as the rootkit thing goes...It installs to your computer completely transparently. I had a few Sony BMG CDs, and I agreed to no such TOS. It just played on my computer and installed the rootkit without as much as a prompt.

Are they doing a console ban? Or is it a IP Ban?

Console ID, if it was IP a simple proxy would get around it.
