It's an exploit in themes. Sysnand loads the theme, which loads boot.3dsx.

Yes, unless your referring to the unreleased arm9loaderhax.

themehax loads boot.3dsx from the sd card. so that could be replaced with a homebrew renamed to boot.3dsx - this could cause some pathing issues though for hombrew that read assets from sd.
