People's ethics are different, but 'pirating' games that can't be legally bought anymore isn't the same as downloading modern warez for Switch games that came out a week ago.
Vintage ROMs fall into the former camp. You do whatever you like with that info.
But this really isn't the place to be changing topics when Switch piracy is just all bad (unless you actually use your own gamecard dumps, which would be legal backups).
You're downloading and enjoying someone's work and he doesn't get anything out of it in return. That's pretty much piracy how much you sugar coat it. I do download roms and even I'm going to admit what I'm doing is wrong and I'm not going to justify it by saying it's fine because those aren't sold anymore.
 
Piracy is piracy. You are not entitled to someone else's intellectual property just because they're not officially selling it anymore. You are a pirate playing illegal copies of games. Don't cry about pirates when you are a pirate yourself.

Doesn't make pirating Switch games any less immoral, which was the point of my original comment.

Two completely different ethical viewpoints and we have our ways of using emulators.

Buying used games is also piracy. It hits the same checkmarks that piracy does. It's taking advantage of someone's work without them getting anything in return for it. Heck borrowing a game from a friend does the same thing.

Can I get some clarification on this driver? Is this driver "homebrewed"? Or is it from another source? Do all homebrews use the same driver that Retroarch is using? I would have figured a sd card driver would be initialized on horizon boot, is that not how it works?

The driver is in Nintendo's FS (fileystem) service.
All homebrews, including Horizon itself, use that Service.
 
So official titles use this same sd card driver, right? I would think that if official software is accessing SD card, which they do, there would be problems widespread but I haven't heard much on OFW/legit use about corruption. Is this a problem with official software?

Perhaps there's official documentation or a fix with up to date devkit software and authorized devs don't even have to worry? I just can't see how it seems like only 1 homebrew program causes this issue, and there's gotta be 1,000 other titles that have no issue, especially when they all use the same supposedly bugged sd card driver.

No. Game devs are not allowed to read/write from/to SD whatsoever.
Not a single game does that.
 
Hmm, alright, that makes sense, but what about screenshots, video captures, etc? The user can choose to write to sd at any point, this would be an example of official software read/write to sd, correct?

This is done by the system in a controlled manner.
Adding a 3rd party (homebrew and official titles that *would do it, theoretically*) can wreck havoc.
Corruption is happening on OFW too, its just so rare because almost nothing accesses SD.
 
Thanks for your clarification man, I don't mean to grill ya haha, I just would love to see a solution and I try to understand.
