    I feel like that would be a poor business decision. Regardless it is jailbroken, and they are advertising it.

    That iPhone has Cydia on it, its the app to install the other (pirated/homebrew) apps iirc.

    Correct as usual. also you can see the background as well as the menu at the same time. That is also a dead give away.

    I'm sorry but that's dead wrong.

    Cydia has nothing to do with pirating at all. There are some apps on alternate sources that host apps that allow you to do piracy related things, but Cydia is 100% homebrew.

    The main/default sources in cydia (the ones with 1000s of JB apps) frown upon piracy and won't allow any apps related to piracy on their source.
