Well TX could say that they came up with the code first and RS stole it... how would you go about proving that in court? Also do you know how much money it would cost RS to take TX to court...? Not worth the argument
Technically it wouldn't be stolen, it would have been pirated.

Read. That's all you have to do. Read a few pages of the thread, since the info appears on several pages: Open Source doesn't mean there aren't terms of conditions. Those conditions are outlined in a license, which Atmosphere has, and TX violated.

That first part just isn't true and you know it. Sheeeesh
You can use your own code however you like, even if you published it under Open Source license.
You can buy rights from the code contributors and do with the said code whatever you like.
You can use SX OS for legit backups and homebrew. Like any other CFW. You may not like that it is not free but there is nothing more "pirate" about it.
And the license must go with them. Anyone, including myself, could download the source to look at, but if I were to distribute a working, modified copy, then I must follow the same license agreement that the original developer has laid out, in this case the GPL.
Become a patron then and make a change.
I'm not arguing. IJS it's pretty dumb to even be considering the legalities of the licensing due to the nature of the work, the location of the offending team, and the numerous pot/kettle flaws in the arguments presented.
And contrary to popular belief, GPL does not require to publicly host source code. One should provide the code upon request only.
So someone should politely ask TX for the Atmosphere code if they use any.

Fair and accurate point. They will be required to release the code upon request. However the question now is if they truly did use Atmosphere code, how could we have figured it out? We have one piece of evidence, but they could argue that that line is simply a coincidence and they made it too, and that their code is entirely proprietary, made without grabbing it off the internet. If they indeed are willing to violate the GPL, they will try to remove all evidence they can that shows they did copy from someone else.And contrary to popular belief, GPL does not require to publicly host source code. Wow i actually defended these people beceause of their rep in the xbox modding days this clearly isnt the same team and makes SXOS look like a total cash grab. I was expecting 2 competeing OS's i mean the BL is defiantly their work but this is just ashame SX OS users problem on a outdated version of Hekate with a backuploader

Yes it was locked with a password. The password is Wanna Play? BTW it was reversed without the password.
Cant argue with that. They should credit naehrwert and others right on the splash screen.
