So a popular ROM website is currently not serving DS ROMs right now, they've been contacted by the ESA to remove the problematic ROMs.

This kinda sucks. It was my favorite ROM site, and because of this, when the NDS ROMs go back online, it'll mean all the first-party games (and other ESA members' games) won't be available for download.Download Page said:The NDS ROMs are currently off-line.
The goal of *our ROM site* has always been to provide users with an opportunity to try out games in order to determine whether it is a game worth purchasing or not. We have always respected when publishers or developers felt *our ROM site* did more harm than good to the sales of their product, which is also why the NDS section is now off-line.
The ESA contacted us on behalf of their members, who had concerns that our service was doing more harm than good, so as per our goal and beliefs we have complied with their request to remove the intellectual property of their members. Since they represent a lot of companies we have decided to take the entire NDS section off-line until we can go through each of the titles and determine whether they belong to an ESA member or not.
We understand that this may frustrate users who were looking for new games to test but we hope you also understand that this is both necessary and in accordance with our beliefs.
