(thirst thread be gentle....) i'v been on 10.1 with a old us 3ds, and i was always checking in Pokemon shuffle to get the newest data. when i tried today it said i cant use online services without a update. i do have homebrew (themehax is my means) does this mean NO online services will work now?

It's blocked just like the eshop firmware spoof, an update to the Hans firmware spoofing may allow it to get back on but who knows if it will or if it will even be able to read the updated check in data through Hans if it even does work.

It safe to just assume it's blocked for good until you see otherwise now.
