You do need to have a previously purchased subscription in order to download Pokemon Transporter – unless you use the homebrew that just came out recently.

Once that's done it counts as being acquired on the account, regardless of the status of Bank. It's still an option that people can use and doesn't involve piracy by trying to find a cia of it somewhere.I said legally, so no use of homebrew.
