Actually, we don't know. It seems that nobody has ever been banned for playing online.
Technically, Nintendo probably couldn't know you are on CFW. BUT, if you play with DLC only available on eshop, it's possible to Nintendo to check there is a inconsistency if you don't pay for it and play with it online (MK8 DLC for example)

Is that safe to do? I was thinking about doing that, not worried about bans.. worried about a random system update that I can't stop from happening

So, keep your DNS on and fire up Splatoon or whatever you want to play online. Nintendo will ban you if you will cheat tho.
