I'm not too worried about this.

It's a cart that is not intended to bring further revenue for the company, so there is no loss there.

I also don't believe it will aid in circumvention of new game sales.

Well, from what I've seen this program is only intended for use on PRE-DSi models and will not operate on the DSi.

Unless he was behind 20 proxies, it isn't a good idea to just publicly say on every rom site that he was the one who dumped them.
iND would be enough.

Or he just uploads it as a regular file without any affiliation to any release group and waits for a scene group to get a hold of the file to spread it.

20 proxies? OMG It is easier than this, just go to a different town, learn to use aircrack and that pentesting tools and upload it from the linux tool you used to share wifi. It is very anonymous and easy

He has already posted very publicly here that he has dumped it. What difference would it make if it were on a ROM site?

When he upload it secure and discretely, than nintendo has no prove that he was it. Anyway I dont think nintendo would report against him and when, than it would be abolished because of a lack of evidence.

Also, he's the only one who has access to this cartridge so it's not like any old person can go and upload a dump of this debug cart. It doesn't take Sherlock to put two-and-two together and figure out that he dumped it.

People are forgetting one thing: what kind of damages could Nintendo claim? This software is harmless to their revenue flow.
