Hardware Odd problem with upper screen on the new Nintendo 3DS XL

Hi,
i have the following problem with my new Nintendo 3DS XL:
The upper screen is not working, but if i start the internet brower or old DS games it works (it flickers a bit). Basicly it stops working as soon as any 3d content is being displayed, despite the 3d-mode being deactivated.
I have already updated the firmware und reseated all the connectors.
Does someone have an idea what this could be?

It's simply hardware defective, if the console is still under warranty, well, call Nintendo support and ask for replacement.
