Thank you for your answer@OnyXxX probably not unless new telemetry is implimented but i doubt they will as thats a legal issue (for nintendo) to scan SD cards, i'm supprised it is a legality issue since according to any game console maker you don't own your console, then again they got in trouble in the EU by "forced updating" the Wii U (auto updates fq in standby and if you don't agree to the EULA it shuts down) then again MS intentionally bricked 360's that were JTAGED anyways point is i 100% doubt they could impliment a way to scan files on a SD card so as he told you as long as you only install nsps on emunand your fine a good way to help is to install a custom theme on emunand so you can tell easily what fw you're on
Even operating under the assumption that they can somehow legally scan the SD card, the files are not what leads to the hack therefore banning people just because they have the files will lead to a lot of false positives. I highly doubt the risk would outweigh the benefit and Nintendo is already receiving creating enough bad publicity for themselves.It is just more safe to switch sd card every time?
For exemple when I want to play online on my clean sysnand I use my clean 64gb sdcard and when I want to go on my offline emunand I switch to my 128gb sd card with the atmosphere/emunand partition?
I mean they probably don't have the right to scan sd card but i'm sure they can find a way to ban us on telemetry we don't know
First off, there is no such thing as "semi-bannable". You are either risk for getting banned or not and using homebrew can get you banned. I’m not 100% sure what happened. I bought the switch off eBay a few months ago. I’ve never actually fully understood the whole “clean my nand “ thing either.
I used JKSV and had friends use my loot island.
I used incognito on my emmu to play resident evil 5. Downloaded from tinfoil. Never on stock.
when I FIRST hacked my switch, I may have had the emmu online directly to Nintendo servers.. as the directions in birbs guide were unclear for me. I did use 90 DNS at first, then incognito.

Well no but its also pointless for you to remove the SD card. There are a plethora of reasons Nintendo cannot ban you just for files on your SD card such as legality issues or false positives.My emunand is using firmware 10.2 , but I updated the sysnand to the newest firmware 11.0.1. It’s important to mention that I’ve never went online using emunand and I also have incognito installed.
Whenever I wanna play online I just turn off the console first and remove the SD card, then turn it back on without the SD.
Then if I want to play nsps I turn it off and then put the SD back in, enable rcm mode and launch the exploit.

Installed some games andplayed online all day yesterday. Woke up this morning and Im banned. I used 90dns and incognito 100%.
I guess when I upgraded my FW to 11.1 from nintendo yesterday they must have noticed something was off.

Only CDN bans limit firmware updates but since Nintendo has stopped distributing CDN bans and actually some users had their CDN bans converted to normal bans, it is normal to still be able to update your firmware once you've been banned.Can you update firmware thru OFW normally once you've been banned?
