Because FPS sucks when you have to aim with buttons or the touch screen. Plus with 3d platformers like OoT and KH3D it's much more convenient adjusting the camera with an analog stick as opposed to with the touch screen or L/R buttons.

there's no way the thumbstick near the bottom would be comfortable they put it at the top because the d-pad is meant to be secondary as a backup and we don't need two of them nintendo is not for first person shooters

Two slide pads down the bottom, you'd be holding the 3DS on its near edge or if not it would be mighty uncomfortable.

It might be difficult to hold the thing steady while having both thumbs on the sliders. The unit has to be steady to not screw up the 3D effect.
