You probably already tried calibration and cleaning the screen and stuff like that
I think it's worth trying to swap the digitizers if you have another 3DS or spare digitizer and some experience with repairing electronics

Meh, I'll just ask someone over at Ninty for help, I guess. 'til then, I'll just use my black o3DS for DS games. Though, It is a bit of a pain that all my DSiWare is on my New 3DS XL...
