I would bet that it does happen, i could be wrong... but N has been acting so insecure by going after everything. It kinda tells me they are worried about a possible exploit. Like they maybe overlooked something. That.. or their arrogance just motivates more people to hack it.
I don't see how them going after everything indicates that they're worried about an exploit. For them to be worried about it they would have to already be aware of a vulnerability. If you're already aware, then you're also likely already mitigating/fixing the vulnerability.

I’d bet bans/enforcement and firmware security aren’t even the same department within corporate Nintendo. They’re most likely totally unrelated things and groups of people within the company who only align goals (eg “piracy is bad”) at the Sr leadership level.

Hello. I'm new to the "world" of switch/switch 2, this month July 2025 I bought the Switch 2 and the Mig Flash V2 cartridge. I would appreciate it if you could help me with the following question; of the almost 20 games that are on the MicroSD card in the MIG, the 2 games that do not start are *The Legend of Zelda Breath of the Wild* and *The Legend of Zelda Tears of the Kingdom*, the message appears to update the game, without the option to start the game without updating, as in some games that are on the microsd the message appears to update the game but we have the option to start without updating, in these 2 games no. the console is on firmware 20.1.5 in flight mode and I put the wifi MAC address on the blocked list on the router, I will never connect the Switch 2 to the internet, Mig Flash has firmware 1.2.2 ,All other games work fine but these 2 don't, why does this happen ?, Is there a trick to force the start of a game that asks for an update without the option to start the game without updating ? Thanks.

No, you won't be able to launch these games without updating, because some games require mandatory updating.
You can update it either online or locally via the second switch (switch 1 or switch 2)
Im not completely sure of this as ive never tried it... but doesnt one of the consoles need to be online and/or on the latest FW to that? Or the FW's must match on both?. Something along those lines... I know its not as simple as that. Im thinking more in terms of using a SW1 with CFW to do it.

If I remember correctly, I've tested my MIG Switch flashcart on one of my hacked Switches that was on a lower firmware than the other one that I had the game on with the latest update for it. I'm blocking N servers on both and the local version match worked without issue. Using modded Switch 1 is totally recommended as you can control which version to update your game to.

As far as I know, you should be fine. I've never heard about anyone that got their console banned because of amiibo emulation. At least, on Switch 1. I'm not sure if Switch 2 changed anything under the hood for it.

How long will Nintendo take to banned users? Same day or after 3 days?

Banned switch means more piracy. My switch 2 got banned. Got banned not because I used a migswitch or modded but because by mistake I bought a game account. Well does Nintendo think I would cry over this and just throw away my switch 2 ?

No

I did buy several switch2 games from the eshop which I still play and the ban and arrogance that nintendo uses gave me the incentive to order a migswitch and download a huge amount of pirated games. I always believed that if you cannot go thru the door you can use a window. There will always be a way around. Arrogance never wins!
With banned switch 2 and migswitch... can you still update games by pressing + button and update game? or you cannot do anything? asking bc i want to use my second switch 2 with migswitch to play switch 1 games and im not worried about to be banned if i can still update switch 1 games to play on switch 2.

No you can’t

If your console can’t connect to the internet / servers how do you expect to download the update ?
